Terms of Service

Effective date: [EFFECTIVE DATE] · Last updated: [DATE]

Draft for review. This is a working draft to accompany the app's launch. Have it reviewed by qualified legal counsel and complete every [bracketed] field — including your legal entity name, governing jurisdiction, and a contact address — before publishing it as your live terms.

These Terms govern your use of the Frametage app and the website at frametage.com (the “Service”), operated by [LEGAL ENTITY NAME] (“Frametage,” “we,” “us”). By using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.

1. Who can use Frametage

You must be at least [MINIMUM AGE, e.g. 13] years old to use Frametage. If you’re under the age of majority where you live, you may use it only with the involvement of a parent or guardian. By using the Service, you represent that you meet these requirements.

2. Your account

You can browse Frametage anonymously, and you can create an account by signing in with Google or Apple. You’re responsible for activity that happens under your account and for keeping your sign-in method secure. Let us know promptly if you believe your account has been used without your permission.

3. Beta service

Frametage is currently offered as a pre-release beta. That means features may change, break, or be removed, and the Service may be unavailable at times. The Service is provided for evaluation on an “as is” basis, and we may add, change, or discontinue features at any time.

4. Acceptable use

When you use Frametage, you agree not to:

5. Your content

You keep ownership of the content you create or upload (“User Content”). To operate the Service, you grant Frametage a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (for formatting and encoding), publicly display, and distribute your User Content in connection with running and promoting the Service. This license ends when you delete your User Content or account, except for copies retained in routine backups for a limited time or where retention is required by law.

You represent that you own or have the necessary rights to your User Content, and that it does not violate these Terms or infringe anyone’s rights.

6. Creators and uploads

If you upload films or clips as a creator, you confirm that you hold all rights necessary to do so — including rights to any music, footage, performances, and likenesses in your content — and that your uploads comply with these Terms. You’re responsible for the content you publish.

7. Moderation and enforcement

You can flag content you believe violates these Terms, and you can hide content you’d rather not see. We may review, remove, or restrict content, and suspend or terminate accounts, that we reasonably believe violate these Terms or harm users or the Service. We aren’t obligated to monitor all content, but we may.

8. Intellectual property

The Service itself — including the Frametage name, logo, software, and design — belongs to us and our licensors and is protected by intellectual-property laws. These Terms don’t grant you any right to use our branding without our prior written permission.

9. Third-party services

Frametage relies on third-party services, including Google and Apple sign-in and content-delivery providers. Your use of those services is subject to their own terms and policies, and we’re not responsible for them.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

11. Limitation of liability

To the fullest extent permitted by law, Frametage and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim or [AMOUNT, e.g. USD 100].

12. Indemnification

You agree to indemnify and hold Frametage harmless from claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or the rights of others.

13. Termination

You can stop using Frametage and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination — such as content licenses granted before termination, disclaimers, and limitations of liability — will survive.

14. Governing law

These Terms are governed by the laws of [GOVERNING JURISDICTION], without regard to conflict-of-laws rules. Any disputes will be resolved in the courts of [VENUE], unless applicable law requires otherwise.

15. Changes to these Terms

We may update these Terms as the Service evolves. When we make material changes, we’ll update the effective date above and, where appropriate, notify you in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.
